1. Acceptance

By using favoritesweetshop.com you agree to these terms. They also apply to wholesale and private-label orders placed with Favorite Sweet Shop, 352 Butler St, Pittsburgh, PA 15223, unless a signed agreement says otherwise.

2. Prices and quotes

Prices on this website are wholesale prices for businesses, stated in US dollars per pound and excluding freight. They may change without notice. A quote becomes binding only when we confirm it in writing by email. Obvious typing errors in a price list or quote do not bind either party.

3. Orders

The minimum wholesale order is 25 pounds, with flavors mixed as you like. Private-label orders start at 50 pounds. By sending wrapper artwork you confirm that you hold the rights to all names, logos and designs it contains.

4. Payment and delivery

First orders are paid in advance. Approved accounts may be offered net 30 terms. Orders ship FOB Pittsburgh, so risk passes to you when goods are picked up or handed to the carrier. Report damaged cases within five business days of delivery and include photos.

5. Samples

Sample boxes are sent to businesses only, one per location. The shipping charge is credited against your first order if it is placed within 60 days.

6. Allergens and labeling

Our candy is made on shared equipment that also processes milk, soy, wheat, peanuts and tree nuts. For private-label products that you resell, you are responsible for labeling that meets the requirements where the product is sold. We supply ingredient and allergen statements on request.

7. Limitation of liability

To the extent permitted by law, our liability for any claim related to a product is limited to the price paid for that product. We are not liable for lost profits or indirect damages.

8. Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania. Disputes will be handled in the courts of Allegheny County. If any part of these terms is found unenforceable, the rest remains in effect.
